Terms and Conditions for Ajeero Limited’s Cloud-Based Workforce Management Software Services

 

Welcome to Ajeero’s Terms of Service

 

These terms govern your use of Ajeero Limited’s online staff management system, mobile app services, and software (collectively, “Service”). By accessing or using the Service, clicking “I Agree,” or otherwise affirming your agreement, you acknowledge your understanding and acceptance of these Terms of Use (“Agreement”), including the data practices in Ajeero’s Privacy Policy (available at www.ajeero.com/privacy-policy). Modifications to Terms

 

Ajeero reserves the right to modify these terms, with changes effective upon notice. New features enhancing the current version of Ajeero are subject to this Agreement. This Agreement governs all users globally.

 

Use Conditions

 

By using Ajeero, you certify under penalty of perjury that you are not employed by a competitor and will not share insights gained from Ajeero with any competitors.

 

Eligibility

 

This contract between you and Ajeero requires your agreement before using the Service. The Service is intended for legal adults and entities capable of forming binding contracts. Users under 16 are strictly prohibited, and those under 18 require guardian consent. The Service is designed for employers and employees worldwide, with specific support for designated countries.

 

Your Ajeero Account

 

Your account provides access to services and functionality determined by Ajeero. Different user types may have varied account types. Opening an account for an entity implies you represent and are authorized to bind the entity to this Agreement. Connecting to Ajeero via a third-party service grants us access to use and store information from that service.

 

Account Security

 

Maintain accurate and current information for your account. You are responsible for all activity under your account and are advised to use strong passwords. Immediate notification to Ajeero is required for any security breaches or unauthorized account use.

 

Communication Consent

 

By providing your contact details, you consent to receiving service-related notices and other communications from Ajeero. Opt-out options are available but may limit your access to service updates or offers.

 

Service Use Restrictions

 

Activities prohibited on Ajeero include unauthorized copying, distribution, or disclosure of any part of the Service; misuse of automated systems; uploading harmful content; unauthorized data collection; misrepresentation; and interference with the service’s proper functioning.

 

User Content

 

User-generated content (e.g., profiles, comments) remains your property. However, sharing this content on Ajeero allows others to view, edit, and share it. Ajeero may remove content at its discretion. User Content must respect intellectual property, privacy rights, and laws.

 

Mobile Apps

 

Mobile software for Ajeero use is subject to compatibility and data charges. A limited license is granted for the mobile app, with restrictions on misuse and modifications. Updates may occur automatically.

 

Proprietary Rights

 

All Service materials, except User Content, are Ajeero’s property. Unauthorized use of Ajeero content is prohibited. Ideas submitted to Ajeero become our property without compensation or confidentiality obligations.

 

Paid Services for Ajeero Limited

 

Billing Policies and Pricing

 

Ajeero offers certain features of its Service for a fee. If you choose to use these paid aspects, you agree to our pricing and payment terms, as may be updated periodically. Details of these terms are available at ajeero.com/pricing. A valid credit card is required for paying accounts.

 

Fee Adjustments

 

Ajeero reserves the right to introduce new services for additional fees and to modify existing fees and charges. This includes changes to monthly subscription plan fees. Before any pricing or payment term changes take effect, Ajeero will provide a 30-day advance notice.

 

Refund Policy

 

All charges related to the Service are non-refundable. This includes fees paid in advance for monthly or annual plans and any setup fees. There are no refunds or credits for partially used service periods, nor are there refunds for unused account time even if the account is active.

 

Billing Cycles and Payment Information

 

Billing for Ajeero services is conducted on a recurring and periodic basis (billing cycle). This cycle will be set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing the Service. At the end of each billing cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or Ajeero cancels it. You must provide accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method.

 

Changes to Subscriptions

 

If you want to change your subscription plan, this can be done at any time by contacting Ajeero’s support team. The subscription change will become effective at the end of the current billing cycle.

 

Cancellation and Termination

 

Account Cancellation

 

You have the right to cancel your Ajeero account at any time. To cancel your account, you must formally request cancellation through an email with a read receipt or a direct phone call to Ajeero’s support team. Cancellations by email or phone are the only recognized methods for account termination.

 

Effect of Cancellation

 

Upon the cancellation of your account:

 

  1. You will no longer have access to your account or any data within the Ajeero environment.
  2. All your data and content within the Ajeero system, including user information and scheduling data, will be irrevocably deleted. This action is final and cannot be reversed.
  3. If you cancel your account before the end of your current paid-up month, your cancellation will take effect immediately, and you will not be charged again.

 

Termination by Ajeero

 

Ajeero reserves the right to suspend or terminate your account at any time for any reason, including but not limited to a breach of these Terms. Such termination or suspension may result in the forfeiture and destruction of all information associated with your account.

 

Post-Termination Responsibilities

 

Upon termination:

 

  1. All legal obligations and liabilities incurred by either party prior to the termination date shall survive the termination of this agreement for all purposes.
  2. Ajeero is not obligated to provide any refund or part thereof for any time not used on the account.

 

Consent and SMS/Text Messaging for Ajeero Limited

 

Adding Employees & Obtaining Consent

 

Ajeero’s platform allows for the easy addition of employees to your Ajeero environment. This feature facilitates effective management of schedules and communication via messages. When you add employees to your Ajeero environment:

 

  1. Employee Consent: You represent and warrant that each employee you add has provided explicit consent to be added to the account. This consent includes agreement to receive administrative messages from Ajeero and text messages from you or anyone else associated with your Ajeero account.
  2. Verification of Consent: It is your responsibility to ensure and verify that such consent has been obtained. Ajeero may request proof of this consent at any time to verify compliance.

 

Receiving Messages from Ajeero

 

As part of the Service, Ajeero may send periodic administrative messages to both employers and employees. These messages are an essential component of the Service. By creating an Ajeero account and using the Service, you agree to receive these communications, which may include but are not limited to:

 

  1. Welcome Messages: New employees added to an employer’s Ajeero account may receive an initial welcome message, instructions for Service registration, and information about the Service.
  2. Service Updates: Notifications about changes, updates, or enhancements to the Ajeero platform.
  3. Administrative Alerts: Important messages regarding account management, security updates, and other critical communications.

 

Text Messaging and Charges

 

  1. Opt-In for Text Notifications: You may opt to receive certain notifications from Ajeero via text messaging. These messages can provide timely information relevant to your use of the Service.
  2. Carrier Charges: Be aware that standard text messaging rates and data charges from your mobile carrier will apply to text messages sent or received as part of using Ajeero’s Service. These charges are your responsibility.
  3. International Charges: If you are using the service outside of your home country, or if your employees are international, additional roaming or international charges may apply. Always check with your carrier for specific text messaging rates.

 

Privacy and Data Use in Messaging

 

  1. Use of Personal Information: Any personal information collected for text messaging or communication purposes will be used in accordance with Ajeero’s Privacy Policy. This includes safeguarding your personal data and not using it for unrelated marketing without your consent.
  2. Revocation of Consent: You may withdraw your consent to receive text messages at any time by replying STOP to a message, or through

your account settings. Upon opting out, you will no longer receive text messages from Ajeero, but this may impact your ability to use certain features of the Service effectively.

 

  1. Data Handling: Ajeero ensures that all data handling for text messaging adheres to relevant data protection regulations. This includes securely storing and transmitting personal contact information and respecting user privacy.

 

Responsibility and Compliance

 

  1. User Responsibility: As a user of Ajeero’s Service, you are responsible for ensuring that all phone numbers provided for text messaging are accurate and current. You are also responsible for maintaining the consent of each individual associated with these phone numbers throughout their use of the Service.
  2. Legal Compliance: Ajeero commits to complying with all applicable laws and regulations regarding text messaging and electronic communications. As an employer or user of the Ajeero system, you are also expected to comply with these legal standards, including respecting the privacy and communication preferences of your employees.

 

Indemnification for Messaging

 

You agree to indemnify and hold harmless Ajeero from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from your failure to obtain the necessary consents for text messaging or from your non-compliance with applicable messaging laws and regulations.

 

Third-Party Links

 

Ajeero is not responsible for third-party sites, materials, or services accessed through the Service. Your interactions with third-party advertisers are solely between you and the advertisers.

 

Indemnification

 

You agree to defend, indemnify, and hold harmless Ajeero from claims arising from your use of the Service, violation of this Agreement, or infringement of third-party rights.
